Terms of Use (EULA)

These Terms of Use ("Terms") govern your use of the SmartDiet mobile application ("the App") provided by Łukasz Krawczak ("we", "us"). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.

1. The service

SmartDiet is a nutrition and fitness tracking app offering a calorie counter, food diary, macronutrient tracking, AI meal recognition from photos, an AI assistant ("Tao"), weight tracking and optional health data integration.

2. Eligibility & account

You must be at least 16 years old to use the App. You are responsible for keeping your account credentials secure and for activity under your account.

3. Subscriptions & billing

• SmartDiet offers an auto-renewable subscription, SmartDiet Pro, available as a Monthly or Annual plan.
• Indicative prices: Monthly USD 9.99, Annual USD 79.99. Actual prices are shown in the App and may vary by region and over time.
• Payment is charged to your Apple ID at confirmation of purchase.
• The subscription renews automatically unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• You can manage or cancel your subscription in your App Store account settings. Cancellation takes effect at the end of the current paid period.
• Use of the App is also governed by Apple's standard end-user licence agreement: apple.com/legal/internet-services/itunes/dev/stdeula.

5. AI features

Meal recognition, nutritional estimates and AI assistant responses are generated automatically and may be inaccurate or incomplete. Verify important information before relying on it.

6. User content

You retain ownership of the photos and content you submit. You grant us a limited licence to process that content solely to provide the App's features (e.g. meal recognition). Do not submit content you are not entitled to share.

7. Acceptable use

You agree not to misuse the App, including: reverse engineering, interfering with its operation, attempting unauthorised access, or using it for any unlawful purpose.

8. Intellectual property

The App, its design and content (excluding your user content) are owned by us and protected by law. These Terms grant you a personal, non-exclusive, non-transferable licence to use the App.

9. Disclaimer of warranties

The App is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect or consequential damages arising from your use of the App. Nothing in these Terms limits liability that cannot be limited under applicable law, including mandatory consumer rights.

11. Termination

You may stop using the App at any time. We may suspend or terminate access if you breach these Terms.

12. Governing law

These Terms are governed by the laws of Poland, without prejudice to mandatory consumer protection rights you may have in your country of residence.

13. Changes

We may update these Terms. Material changes are reflected by the "Last updated" date above. Continued use after changes means you accept the updated Terms.
